Online Banking Terms and Conditions

Agreement to Receive Electronic Communications

You agree that we may provide the Agreement and any amendments or revisions to you in electronic form. You also agree that we may deliver via electronic communication any future notices and information as may be required by law or regulation to be provided to you pertaining to the Online Banking Services. These notices may be delivered by posting the Notice (or a link to the Notice) on our website or by sending the Notice to the email address that you have provided to us. You agree to promptly update your email address if it changes by logging into your online banking and updating the email address under User Options.

You may withdraw your consent to receive electronic communications and cancel your Online Banking service by calling Century Bank Online Banking Department at (478) 453-3571 or by sending written notice to Century Bank & Trust, Online Banking Department, PO Box 768, Milledgeville, GA 31059-0768.

User ID and Password

Your User ID will be a 12 digit assigned ID Code provided by Century Bank. You will be required to create a Password containing 8 - 25 alpha-numeric characters. The password is not case sensitive. You authorize us to follow any instructions entered through online banking using your User ID and Password. Because this information can be used to access money in your Account(s) and to access information about these Account(s), you should treat your Password with the same degree of care and secrecy that you use to protect your ATM/Debit card PIN and other sensitive financial data. For security reasons, you will be required to change your Password every three months.

You agree not to give or make available your Password or account number(s) to any person who is not authorized to access your Account(s). If someone to whom you have granted authority to use your User ID and Password exceeds such authority, you are fully liable for all transfers and payments made by such person until you have notified us that you have terminated the authority granted to such person and have given us a reasonable period of time to act upon such notice. We may require that you put this notice in writing, and may require you to immediately change your Password. We may also require you to identify the person or persons you believe exceeded authority and to cooperate with us in the investigation and prosecution of any person who has used your User ID and Password without your authorization.

Service Hours & Customer Support

Online Banking services are available 24-hours a day, seven days a week, except during maintenance periods, for the scheduling, modification, or review of bill payment items, and for initiation of funds transfers and balance inquiries.

Online Banking customer support is only available during Banking hours. Century Bank is open Monday-Friday from 9:00 a.m. to 5:00 p.m. Our Online Banking personnel can provide support on logging into our Online Banking and on the proper use of the features. These personnel cannot provide advanced technical support.

Century Bank's Liability (Applicable to Consumers Only)

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  1. If, through no fault of ours, you do not have enough money in your account to make the transfer.
  2. If you have an overdraft line and the transfer would go over the credit limit. The maximum number of overdraft fees you may be charged in a day for overdrawing your account is five (5) or $135.00.
  3. The funds in your account are subject to legal process or other encumbrance restricting such transfer.
  4. If the service, your PC, or modem is not working properly and you know about the malfunction when you started the transfer or payment.
  5. If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
  6. If you have not properly followed the instructions for using Online Banking.

Limit on Transfers from Money Market and Savings Accounts

Under Federal Regulation D, transfers via online banking are considered one of the limited types of transactions. The total of limited transactions may not exceed six during a statement cycle. If an online transfer would result in a Regulation violation, the transfer request may be rejected. For more information on the types of transactions that are considered limited, please contact Century Bank.

Fees

There are no monthly fees accessed by the bank for use of Online Banking services with the exception of the Stop Payment feature. Current fee for Stop Payment is: $17.00* Online Discount

Confidentiality

We will disclose information to third parties about your account or the transfers you make:

  1. where it is necessary for completing transfers; or
  2. in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or
  3. in order to comply with government agency or court orders; or
  4. if you give us written permission.

Electronic Messaging

Century Bank Online provides you with the ability to send electronic messages to us. Please remember that we will not immediately receive an electronic message sent by you. No action will be made on any electronic message you send to us until we actually receive your message and have a reasonable opportunity to act on it. Regular email should never be used to send private account information such as account numbers and tax identification numbers because this is not a secure means of communication.

Electronic Messaging CANNOT be used to notify us of lost or stolen Passwords, unauthorized transactions, stop payments, or changes of address.

From time to time, we may send important notices to you concerning your use of Online Banking by electronic messaging.

Your liability (Consumers Only)

Tell us at once if you believe your Password has been lost or stolen. Telephoning is the best way of keeping your possible losses down. All funds could be compromised (plus your maximum overdraft line of credit). The maximum number of overdraft fees you may be charged in a day for overdrawing your account is five (5) or $135.00.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not receive money lost after 60 days.

If you believe your password has been lost or stolen, or that someone to whom you have granted authority to use your User ID and Password has exceeded such authority, or that someone has transferred or may transfer money from your account without your permission, call or write us at the telephone number or address listed below.

ERROR RESOLUTION NOTICE (Applicable to Consumers Only)

In Case of Errors or Questions about Your Electronic Transfers, Call or Write us at the telephone number or address listed above, as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.

  1. Tell us your name and account number (if any).
  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will determine whether an error occurred within 10 business days (5 business days for Century Bank & Trust VISA® Check Card point-of-sale transactions and 20 business days if the transfer involved a new account) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a new account, a point-of-sale transaction, or a foreign-initiated transfer) to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days (5 business days for Century Bank & Trust VISA® Check Card point-of-sale transactions and 20 business days if the transfer involved a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account. An account is considered a new account for 30 days after the first deposit is made, if you are a new customer.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.

You may ask for copies of the documents that we used in our investigation.

Limitation of Liability

We are not responsible for any loss, damage, or injury resulting from an interruption in the availability of Online Banking, or any computer virus that you may encounter using Online Banking. We encourage you to routinely scan your PC using a reliable virus protection product to detect and remove viruses from your PC.

Except as otherwise provided in this agreement or by law, we are not responsible for any loss, injury, or damage whether direct, indirect, special, or consequential, caused by Online Banking or the use thereof, even if we have been advised of the possibility of such damages or losses. Century Bank & Trust makes no warranty, express or implied, to you concerning Online Banking, unless disclaiming such warranty is prohibited by law.

If any provision of this Agreement is determined to be void or invalid, the remainder of this Agreement shall remain in full force and effect.

Century Bank can supply a printed version of these terms and conditions upon request.
